TERMS AND CONDITIONS

Summary

The terms and conditions prescribe the terms governing the opportunity for our customers to participate in its referral program (the “Program”) where they will receive a $500AUD Reward (“Referral Reward”) in exchange for new user referrals who engage and sign on with King Kong for the ‘Quantum Growth Full Program’. We reserve the right to amend or terminate the Program at any time, for any reason. The Program is administered by King Kong. 

All referrers and referees are bound by these Terms and Conditions by participating in the Program. By participating in the Program, Referrers agree to use the Program in the manner specified in these Terms and Conditions. If you do not agree to these Terms and Conditions in their entirety, you are not authorised to register as a Referrer or to participate in the Program in any other manner. Referrers may not participate in the Program where doing so would be prohibited by any applicable law or regulations.

We reserve the right to modify or amend at any time these Terms and Conditions and/or the methods through which rewards are earned. We reserve the right to disqualify any Referrers from participation in the Program at any time at our sole discretion, including without limitation if he/she does not comply with any of these Terms and Conditions or otherwise fails to comply with any applicable laws

Definitions

Quantum Growth Full Program means the product offered by King Kong of the same name for the value of $12,000.

Product Transaction means the purchase of the Quantum Growth Full program, paid in full, without offset.

Valid Link means the referral link generated by a valid Quantum Growth Full program existing customer. 

  • User Referral
      1. Each Referee will be an entity who has not previously engaged with King Kong for the provision of services. 
      2. The Referrer must be an existing Quantum Growth Full paying customer of King Kong, who has paid the entire price of the service, without offset. 
      3. The Referrer is not obliged to refer any users to King Kong and may enter into other similar referral arrangements with other parties. 
      4. King Kong is not obliged to accept any users by a Referrer and will only accept users at its own discretion.
  • Method of Referral
      1.  All eligible Referrers will receive a personalised and valid link to the Reward (the “Link”) via the email address provided to King Kong at the purchase stage. This email address must be the same email address linked to their PayPal account. 
      2. The Link may be sent to the potential Referee(s) by all means of online communication. 
      3. Once a Referrer refers a Friend (‘Referee’) and the Referee successfully purchases the Quantum Growth Full Program, he/she/they will be provided with a confirmation email.  
      4. All Referees must complete the product transaction via the Link. The product transaction must be completed by the Friend within 3-months from the date the Link was received.
      5. Referrers must respect the spirit of the Program by only referring real individuals who meet the requirements of these terms and conditions. Referrers cannot refer themselves for the Reward. 
  • The Reward
      1. The Referral Reward is the sum of $500AUD.
      2. The Referral Reward is due and payable by King Kong in accordance with clause 4, and upon the following events occurring:
        1. The Referer has provided the Referee with a valid Link;
        2. The Referee has accessed the product order page via the Link;
        3. The Referee has purchased and paid in full, the Quantum Growth Full program; and
        4. King Kong has received the fee for the product in full and without offset.
      3. King Kong retains the right, at its complete discretion to alter or amend the sum of the Referral Reward. 
      4. Only one Referral Reward can be earned for each Referee at one time. 
    2. Reward Processing
      1. Once the Reward is due and payable, King Kong will review all relevant information and initiate a payment via PayPal using the details provided at the point of purchase. 
      2. If you no longer have access to the original payment method you may request to have the Reward refunded to another account that:
        1. Is in your name; and
        2. You can verify with a recent bank statement to be provided upon request.
      3. You will receive the reward within a certain amount of time, depending on external issuer’s policies. 
    3. Processing Time
      1. King Kong aims to process all Rewards within 14-days from the time of them being eligible. 
  • Privacy Protection
      1. King Kong agrees to keep all Referred User information confidential in accordance with its Privacy Policy that can be found at https://qg.kingkong.com.au/privacy-policy-2/ 
  • Restrictions
      1. King Kong has placed the following restrictions on the Referral Reward. These restrictions are as follows: 
        1. Only current Quantum Growth Full customers who at the point of purchase used PayPal to pay the fee for the service, are eligible for the Program. 
        2. A Referrer or Referee cannot misuse the Link outside of the terms outlined in this document.
        3. All Links are produced by King Kong for the benefit of the Referer and the Referee as intended. Any Link not produced by King Kong is invalid.
        4. Rewards have no monetary value and may not be redeemed as cash. Rewards are non transferable and may not be auctioned, traded, bartered or sold. 
        5. Upon the termination of the referral program or any portion thereof for any reason, any unredeemed Rewards that have not yet been processed in accordance with these terms, are forfeited.  
        6. In the event a refund for the Quantum Growth Full program is granted, the refund sum will be minus all Referral Rewards already paid.
      2. The Referral Reward is granted entirely at the discretion of King Kong. It reserves its right to deny or withhold all Rewards that are reasonably suspected of being made under fraudulent circumstances.
  • No Agency
      1. These terms do not create any legal or fiduciary relationship between parties.
      2. Referrer, its employees, servants or agents must not represent, convey or in any way make out to be an agent, partner, representative, employee, contractor or affiliate of King Kong. 
      3. Neither party shall have any right, authority or permission to legally bind the other party to any contract, arrangement or obligation. 
  • Indemnity
      1. The Referrer agrees to indemnify King Kong against any loss, damage, liability or expense incurred by King Kong arising directly or indirectly from:
        1. A breach of these terms; or
        2. Any negligent or wilful act or omission of the Referrer or anyone acting on the Referee’s behalf. 
  • General Provisions
    1. King Kong may amend these terms by giving notice to all Parties.
    2. In the event any of the terms is held to be invalid, illegal or unenforceable, then such provision will be fully severed and the terms will be construed and enforced without that severed provision. 
    3. The rights under these terms are non-assignable. For the avoidance of doubt:
      1. No future Referral Reward will be due and payable to Referrer if these terms is terminated pursuant to clause 7, whether the right ot the Referral Fee arose prior to the termination or otherwise;
      2. The relationship between the parties will be served so that there is no longer an obligation to pay a Referral Fee. 
    4. These terms are governed by the laws of Victoria and the parties agree to submit to the exclusive jurisdiction of the Victorian Supreme Court.
